1. Agreement to Terms

By accessing or using Hargos.ai ("Service," "Platform," "we," "our"), operated by XEOPS.AI SARL (SIREN: 989 493 226, RCS Paris), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," "your") and XEOPS.AI SARL. We reserve the right to modify these Terms at any time with 30 days notice. Continued use after changes constitutes acceptance.

2. Definitions

• "Authorized Target" means any website or web application you have explicit permission to scan.
• "Scan" means a security assessment performed by our platform against an Authorized Target.
• "Vulnerability Finding" means any security weakness detected and reported by the Service.
• "Report" means the security assessment document generated after a scan.

3. Service Description

Hargos.ai provides automated web application security scanning services designed for businesses without dedicated security teams. Our services include:

• Automated vulnerability scanning of websites and web applications
• Complete website mapping (pages, subdomains, entry points)
• Detection of common vulnerabilities (OWASP Top 10)
• Clear, actionable security reports with remediation steps
• Continuous monitoring and recurring scans

4. User Accounts

To use our Service, you must:

• Provide accurate registration information
• Be at least 18 years old
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are solely responsible for all activities conducted through your account.

5. Authorization Requirement

By initiating a scan, you represent and warrant that:

• You own the target website, OR
• You have written authorization from the website owner

We verify domain ownership before every scan. We may request additional proof of authorization at any time.

6. Acceptable Use

6.1 Permitted Use

• Security scanning of your own websites
• Authorized security assessments for your clients (agencies)
• Regular monitoring of your web properties

6.2 Prohibited Activities

• Unauthorized Testing: Scan websites without permission
• Malicious Use: Use findings for data theft or illegal activities
• Disruption: Attempt to overload or disrupt target systems
• Reverse Engineering: Attempt to extract our algorithms or proprietary techniques
• Resale: Resell our services without written agreement

7. Subscription and Billing

Current pricing (all prices in EUR, excluding VAT):

• Standard Plan: €89/month — 1 website + all subdomains, 5 scans/month, complete vulnerability detection, reports with fix instructions, email support

Prices are subject to change with 30 days notice.

• Subscriptions are billed monthly via Stripe
• All payments are non-refundable except as required by EU consumer law
• Failed payments result in service suspension after 7 days
• VAT is applied based on your billing address
• You may cancel at any time — cancellation takes effect at end of billing period

8. Intellectual Property

Hargos.ai, our scanning engine, and all related content are owned by XEOPS.AI SARL and protected by intellectual property laws.

You retain all rights to your scan results and security reports. We do not claim ownership of your data. You grant us a limited license to process your data solely to provide the Service.

10. AI Processing

Our Service uses AI to analyze websites and detect vulnerabilities. When you use our Service:

• Your website data is processed by AI models to detect security weaknesses
• AI processing occurs within EU jurisdiction (France)

11. Warranties and Disclaimers

Automated security scanning is a supplement to, not a replacement for, professional security audits.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XEOPS.AI SARL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

13. Termination

You may delete your account at any time via your account settings. We may suspend or terminate your account if:

• You scan unauthorized targets
• You violate these Terms
• We suspect fraudulent or illegal activity

Upon termination, your scan data is deleted within 30 days. No refunds for unused subscription time.

14. Governing Law

These Terms are governed by the laws of France and applicable EU regulations (including GDPR). Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

EU Consumer Rights: If you are a consumer in the EU, you retain all mandatory consumer protection rights under your local laws.
